GENERAL TERMS AND CONDITIONS OF SALE (GTC)

These General Terms and Conditions of Sale (hereinafter "GTC") apply to all orders placed on the website www.absolutcashmere.com (hereinafter "the Site"), operated by the company MCC SAS, RCS Nanterre B420 972 622, registered office: 18 rue du Mail, 75002 PARIS, VAT number: FR 91 420 972 622 (hereinafter "absolut cashmere").

The Customer declares to be a natural person of legal age, not acting in a commercial capacity, and in a personal capacity. They may order as a guest or via a customer account. All orders imply full and unreserved acceptance of these Terms and Conditions in effect on the date of the order.

Absolut Cashmere reserves the right to modify these Terms and Conditions at any time.

ARTICLE 1. YOUR CUSTOMER ACCOUNT

The customer has the option to create a personal account or order as a guest. Creating an account allows:

· to facilitate subsequent orders,

· to track orders and deliveries,

· to view their purchase history,

· to manage their personal information,

· to make product returns easier to access.

The Customer is responsible for maintaining the confidentiality of their login credentials and for all transactions made through their account. If you suspect that your account is being used by a third party, we recommend that you change your password and contact us to close the compromised account if necessary.


ARTICLE 2. HOW TO PLACE AN ORDER?

Product and price offers are valid as long as they are visible on the Site, within the limits of available stock.

  1. Select your products and add them to the cart
  2. Go to your shopping cart to check your selection.
  3. Log in to your customer account, create your customer account, or continue as a guest.
  4. Choose your delivery method
  5. Choose your secure payment method
  6. Confirm your order after accepting the Terms and Conditions
  7. Receive an email confirming your order

ARTICLE 3. PRODUCT AVAILABILITY

Product offers and prices are valid as long as they are visible on the website, subject to availability. For promotional offers, the duration will be indicated on the website and in our communications. In the event of unavailability, Absolut Cashmere will offer a new delivery date or a refund within 5 business days. We may also be forced to cancel your order for a legitimate reason.


ARTICLE 4. PRICE
Prices are inclusive of VAT in euros (€), excluding delivery charges (which will be specified when you choose your delivery method). Absolut Cashmere reserves the right to modify its prices but will apply those in effect at the time of the order. Products remain the property of Absolut Cashmere until full payment is received.

The Customer is informed that depending on the selected delivery country, the displayed price may vary due to local VAT rates, commercial conditions or specific promotions.

For orders delivered outside the European Union, customs duties, local taxes, or import fees may be payable upon arrival of the package. These charges remain the sole responsibility of the Customer, both in terms of declarations and payments to the relevant authorities in the country concerned.


ARTICLE 5. PAYMENT

Secure online payment by credit card (CB, Visa, MasterCard, Amex), Bancontact, Apple Pay, Paypal and in installments via Alma.

Payment is encrypted (SSL) and processed through a secure provider. Absolut Cashmere does not have access to the customer's bank details, which are not stored on Absolut Cashmere's servers.

Payment in installments is offered through the external provider Alma. By choosing this payment method, the Customer accepts without reservation Alma's terms and conditions of use, available on their website: https://getalma.eu/legal/fr-FR/terms/. Absolut Cashmere disclaims all liability for Alma's decisions to accept or refuse the payment. In case of refusal, another payment method must be used.

We want to reassure you that all your transactions are secure. They take place within a strict framework of confidentiality and encryption of all your data by our payment provider.

We do not have access to your personal data concerning your means of payment, including bank card details, and we do not store them on our servers.

In the event of a payment incident, suspected fraud or ongoing dispute, Absolut Cashmere reserves the right to suspend or cancel the order.


ARTICLE 6. DELIVERY

6.1 Preparation time: within 48 working hours from the first working day following payment validation.

6.2 Delivery areas: Metropolitan France as well as many countries (see list in the FAQ link to the website).

6.3 Delivery methods:

  • Express home delivery via Chronopost
  • Express delivery to a collection point via Chronopost
  • International delivery via Chronopost
  • International delivery via FEDEX (fees and taxes to be borne by the customer).

6.4 Prices: calculated according to the geographical area and the chosen delivery method. Standard delivery via Colissimo is free for orders over €200 in mainland France and Europe. Any offers for free or reduced delivery are specified on the Website.

6.5 Tracking: The Customer can track their order from their customer area or via the link provided by email.

6.6 When will you receive your delivery?

The estimated delivery time is indicated when placing your order. In France, it generally varies between 2 and 4 business days from the date of shipment. This timeframe may be extended during peak periods (sales, special offers, etc.) or in cases of force majeure. The customer is notified by email when their package is shipped and is provided with a tracking link.

ARTICLE 7. RETURNS AND REFUNDS

7.1 Timeframe: You have a 14-day withdrawal period starting from the date you receive your order. During this period, you must exercise your right of withdrawal by printing your return slip. Once the return slip has been printed, you then have 14 days to return your package to us by mail. This gives you a total of 30 days to return your order.

7.2 Conditions: the product must be unworn, tagged and in the original packaging.

7.3 Procedure:

  • Returns possible under 30 days after receipt of the package.

  • Application to be made via the Returns Portal or your customer account.

  • A return request = an order (to be shipped separately).

  • Choice of return method: gift voucher (offered), exchange (offered) or  refund .

  • In case of a refund: expenses deducted depending on the country (€2 France/Belgium, €8 other eligible countries); other countries → fees are your responsibility.

7.4 Refund: You will be refunded within a maximum of 14 days after receipt and verification of your return by our services.

7.5 Exceptions: no returns for personalized products.


ARTICLE 8. PRODUCT WARRANTY

The products are covered by the following guarantees:

  • Legal guarantee of conformity: valid for 2 years from receipt of the product. It covers manufacturing defects or non-conformity to the description.
  • Warranty against hidden defects: valid for 2 years from the discovery of the defect.

In the event of a non-conforming or defective product, the Customer may request repair, replacement, or, failing that, a refund. Return shipping costs are then borne by Absolut Cashmere.

The following are not covered:

  • Normal wear and tear from use,
  • Defects due to improper use,
  • Failure to follow maintenance instructions.

ARTICLE 9. AFTER-SALES SERVICE

For any questions relating to the use or maintenance of a product, or in the event of a defective product outside of the legal guarantee, the Customer can contact the Absolut Cashmere Customer Service.


ARTICLE 10. INTELLECTUAL PROPERTY

All content on this Site (text, images, logos, visual or audio elements, etc.) is protected by copyright, trademarks, and other intellectual property rights. Any reproduction, in whole or in part, without the prior written authorization of Absolut Cashmere is prohibited.


ARTICLE 11. LIABILITY AND FORCE MAJEURE

Absolut Cashmere cannot be held responsible for the total or partial non-performance of its obligations in the event of force majeure as defined by case law (natural disaster, strike, pandemic, war, etc.).

Absolut Cashmere is not responsible for indirect damages (loss of opportunity, loss of data, loss of customers, etc.) nor for delays attributable to carriers.

Access to the Site is provided "as is". Absolut Cashmere does not guarantee the absence of errors, viruses, or service interruptions.


ARTICLE 12. RETENTION OF CONTRACTS

Purchase orders and invoices are archived on a reliable and durable medium, which can be produced as evidence.


ARTICLE 13. PERSONAL DATA

Personal data is processed in accordance with the General Data Protection Regulation (GDPR). It is necessary for order management and may be used to send marketing information if the Customer has consented.

The Customer has the right to access, rectify, object to, and delete their data by writing to: absolut cashmere, 18 rue du Mail, 75002 Paris or via the Site form .
